This electronic record is generated by a computer system and does not require any physical or digital signatures .Notwithstanding anything contained or said in any other document, if there is a conflict between the terms mentioned herein below and any other document, the terms contained in the present T&C shall alone prevail for the purposes of usage of the Site.

These Terms of Use are applicable in addition to any arrangement by and between you and the Reseller, and they govern your use of the www.patsan.in Services.
As between you and www.patsan.in as per your relationship with www.patsan.in and unless otherwise specifically indicated in these Terms of Use, these Terms of Use supersede any arrangement between you and the Reseller with regard to your use of the www.patsan.in Services and/or activities in your User Account (or the User Account to which you are added).
Certain services, applications, and features of the www.patsan.in Services may not be available to you or may only be available to you through the Reseller platform.
By accessing or using the Website as a registered user, you represent and warrant that you are competent to contract within the meaning of the Indian Contract Act, 1872, and that you are at least 18 years of age. reserves the right to terminate your registration and refuse access to the Website if it is discovered or brought to our notice that you are under 18 years of age or otherwise not legally capable of enter into a binding contract. SHIPPING & PROCESSING FEE
Shipping and processing charges are levied to compensate PATSAN for costs associated with order processing, handling, packaging, logistics coordination, and delivery of products to the designated shipping address. Such charges, if applicable, will be displayed at the time of checkout before payment confirmation. The Company reserves the right to revise shipping and processing fees from time to time without prior notice, For further details, users are advised to refer to the Shipping & Delivery Policy available on the Website.
DELIVERY
PATSAN endeavours to process and deliver all orders within the estimated timeframes displayed at the time of purchase. However, delivery timelines are indicative only and are subject to change due to factors beyond our reasonable control, including but not limited to logistical delays, force majeure events regulatory restrictions, or unforeseen circumstances.
The Company does not guarantee delivery within the stipulated timeframe, and a delay in delivery shall not entitle the user to repudiate, cancel, or claim damages under the contract, except as expressly provided under applicable law. If a user fails to accept delivery of the goods at the designated shipping address, PATSAN reserves the right to charge additional shipping, handling, storage, or re-delivery fans, as applicable.
LOSS IN TRANSIT
PATSAN shall make reasonable efforts to ensure that products are delivered in good condition and free from defects. Risk in the products shall pass to the user upon delivery to the shipping address provided at the time of order. The Company shall not be liable for loss or damage occurring after delivery has been completed.
The Company does not take title to any returned products unless and until the returned item is received, inspected, and accepted at our designated return facility. Any product purchased on the Website shall not qualify for return unless it is delivered in a damaged condition or has a verified manufacturing defect
In the event that a product is received in a damaged or defective condition, the user must notify PATSAN in writing within 6 days of delivery, along with adequate photographic evidence and relevant order details. Any communication received after & days from the time of delivery shall not be eligible for return or claim, unless expressly covered under an applicable product warranty. This condition shall apply even in cases where an incorrect product has been delivered.
PATSAN reserves the sole and absolute discretion to determine the validity of any claim regarding damage, defect, or incorrect delivery.
PAYMENT
While availing any of the payment methods offered on the Website, PATSAN shall not be responsible or liable for any loss or damage arising directly or indirectly due to: (a) lack of authorization for any transaction; (b) exceeding the preset limit mutually agreed between you and your bank; (c) any payment processing issues arising out of the transaction; (d) technical errors; or (e) decline of transaction for any reason whatsoever.
All payments made against purchases on www.patsan.com shall be towards the MRP displayed on the Website (inclusive or exclusive of applicable charges as specified) and shall be governed by the terms and conditions of the respective third-party online payment gateway service providers engaged by the Company. By proceeding with a transaction, you agree to be bound by the terms and policies of such third-party payment service providers.
Before shipping an order, the Company reserves the right to request additional documentation, including but not limited to government-issued identification and address proof, for the purpose of verifying the ownership of the payment instrument used. This measure is undertaken to ensure a secure and reliable online shopping environment and to prevent fraudulent transactions.
PATSAN may utilise third-party payment facilitators such as banks, payment gateways, wallet providers, UPI platforms, or other authorised financial intermediaries for processing payments. Payments may be made electronically or through Cash on Delivery (COD), if permitted by the Company at its sole discretion. The use of such third-party services shall be subject to their respective terms, user agreements, and privacy policies, and PATSAN shall not be liable for any acts, omissions, or deficiencies attributable to such third-party service providers.
PRODUCT PRICING DISCLAIMER
All prices displayed on the Website, whether for domestic or international purchases, are subject to change without prior notice. The prices displayed typically reflect the MRP of the product and may exclude shipping charges, handling fees, customs duties, international shipping costs, or additional taxes, which shall be charged separately as applicable and clearly indicated at the time of checkout.
The final invoiced amount payable by the customer shall be binding.
All of PATSAN orders are shipped internationally from our warehouse to your provided shipping address via United Parcel Service (UPS). Due to the nature of international shipping, occasionally a customer may have to pay additional import duties and taxes which are levied once a shipment reaches your country. The large majority of orders will not have to pay any additional fees. However, we are unable to calculate when and how much these infrequent customs duty charges will be levied. In the case where additional customs charges are assessed, you will be responsible for paying these additional fees. To make your shopping experience as seamless as possible, we have arranged with UPS to customs clear your goods for you and deliver them to your doorstep. If you are presented with an invoice from UPS for import duties and taxes, you will have to pay UPS directly at the time of delivery. PATSAN takes no responsibility for non-delivery of orders in case such taxes and duties are not accepted and settled by the recipient at the delivery address and will not provide any refunds in such cases
INDEMNIFICATION
You agree to defend, indemnify and hold Gloster Limited and www.patsan.in and its affiliates harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the site.
SEVERABILITY
PATSAN, a brand owned and operated by Gloster Limited (“Company”, “We”, “Us”, or “Our”), reserves the right to modify or update the Website, policies, Service Terms, and these Terms & Conditions at any time without prior notice.
If any provision of these Terms & Conditions is held to be invalid, void, unlawful, or unenforceable for any reason by a court of competent jurisdiction, such provision shall be deemed severable and shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.
FORCE MAJEURE
PATSAN shall not be liable for any failure or delay in performance of its obligations or for non-availability of the Services if such failure or delay arises from events beyond its reasonable control (“Force Majeure Event”).
Force Majeure Events shall include, but not be limited to, acts of God, natural disasters, flood, fire, war, civil commotion, strikes, lockouts, labour disputes, governmental actions, regulatory changes, embargoes, epidemics, pandemics, accidents, power failures, system failures, transportation disruptions, or any other event of any nature whatsoever beyond the reasonable control of the Company that directly or indirectly hinders or prevents performance of obligations.
If the performance of any obligation under this Agreement is delayed due to a Force Majeure Event, the period of such delay shall not be counted in computing contractual timelines. You expressly agree that lack of funds shall not constitute a Force Majeure Event.
APPLICABLE LAW
By visiting www.patsan.in, you agree that the laws of India, under the jurisdiction of the Calcutta High Court, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and www.patsan.in or its affiliates.
DISPUTE RESOLUTION AND JURISDICTION
Any dispute relating in any way to your visit to www.patsan.in or to products you purchase through www.patsan.in shall be submitted to confidential arbitration in Kolkata, India, except that, to the extent you have in any manner violated or threatened to violate www.patsan.in’s intellectual property rights, www.patsan.inmay seek injunctive or other appropriate relief in any court in India or internationally, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing under the Indian Arbitration Act, 1996 (as amended till date). The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

TERMS & CONDITIONS FOR PATSAN GIFT CARDS
1. The PATSAN Gift Card can be redeemed in whole or part across all PATSAN Stores within India and also on www.patsan.in
2. The PATSAN Gift Card is valid for 1 year from the date of purchase and any balance thereafter will be forfeited.
3. Damaged or defaced PATSAN gift Card(s) will not be honoured. There will be no replacement or compensation if card is lost.
4. PATSAN reserves the right to alter terms and conditions of this Gift Card without prior notice. Any dispute shall be referred to PATSAN (Gloster Limited) and the decision of the Company shall be final. Disputes are subject to Kolkata Jurisdiction.
5. This card cannot be exchanged for cash.
